Non-immigrant Status
- H1-B Visas
- Allow employers to temporarily employ foreign workers in the U.S. on a nonimmigrant basis in a specialty occupation of distinguished merit and ability. H1-B visas are limited to 65,000 total per year.
- H-1B1 Visas
- Allow employers to request foreign workers in the U.S. in a specialty occupation from Chile and Singapore. H-1B1 visas are limited to 6,800 total per year.
- E-3 Program
- New legislation, The Emergency Supplemental Appropriations Act for Defense, the Global War on Terror, and Tsunami Relief, 2005, P.L. 109-13, created a new visa cateogory for Australian professionals coming to work temporarily in specialty occupations in the U.S. E-3 visas are limited to 10,500 per year.

- The five categories for aliens seeking to obtain permanent residency for work include:

- Aliens of Exceptional Ability in the Sciences, Arts or Business which includes Professionals with advanced degrees

- Individuals who invest $1,000,000 in a new commercial enterprise or in a troubled business or those who invest $500,000 in a new commercial enterprise or troubled business in a targeted employment area.

- Refugee/Asylum
